These Terms of Service ("Terms") govern your use of the website and services provided by Insom ("Insom," "we," "us," or "our"), a marketing and automation agency based in the Atlanta, Georgia metropolitan area. By purchasing or using our services, you ("Client" or "you") agree to these Terms.
1. Services
Insom provides services that may include automated phone and text systems ("Front Desk" / missed-call text-back), website design and hosting, local search optimization, email and SMS marketing, content, and ongoing maintenance ("Care"). The specific scope of any engagement is defined in your order, proposal, or intake form.
2. Client responsibilities
- Provide accurate, complete information and the content, assets, and account access needed to deliver the work.
- Respond to requests in a timely manner. Project timelines begin when all required content, photos, and access have been received.
- Ensure you have the legal right to use any materials you provide to us.
3. Payments
- Setup fees for automation services are billed upfront at the time of purchase.
- Monthly fees are billed on a recurring basis until cancelled and are non-refundable except as stated in our guarantee below.
- Work begins after payment. Services are paid in full before we start. For larger builds that are split, the agreed upfront amount is due before work begins and the balance is due before the site goes live — we do not deliver or launch unpaid work.
- Third-party registrations (including carrier / A2P 10DLC registration) are filed only after payment is received, because they carry non-recoverable fees and are performed specifically for you.
- Payments are processed by our third-party payment provider. You are responsible for any applicable taxes.
4. Our commitment & refund policy
No long-term contracts — and we don't walk away from a build
We do not consider a setup complete until your system is built and live. If it is not working as described, we will keep working to fix it at no additional charge — we do not abandon a build. There is no long-term contract: you may cancel any monthly service at any time with one email, and you keep your phone number, your website, and your data.
Because setup work and third-party registration costs (such as carrier / A2P fees) are performed specifically for you and cannot be recovered once incurred, setup fees are paid before work begins and are non-refundable. Monthly fees pay for service already provided and are non-refundable, but you may cancel at any time to stop all future billing. Nothing in this section limits any rights you have under applicable law.
5. Revisions
Website builds include two rounds of revisions unless otherwise stated in your proposal. Additional revisions or scope changes may be billed at our then-current hourly rate, agreed in advance.
6. Cancellation
You may cancel any monthly service at any time by written notice (email is fine); cancellation takes effect at the end of the current billing period, and we do not provide prorated refunds for partial periods. On cancellation, you keep your phone number, your website, and your business data. We will provide a reasonable opportunity to transfer or export your assets.
7. Text messaging & compliance (important)
Where we build or operate text-messaging systems for you, you are solely responsible for obtaining valid, documented consent from every contact you message, and for complying with all applicable laws and carrier rules (including the TCPA and A2P 10DLC registration requirements). You represent and warrant that you have such consent. You agree to indemnify and hold Insom harmless from claims arising out of messages sent to your contacts without proper consent or in violation of applicable law.
Carrier registration (A2P 10DLC) is required to send business text messages in the U.S., can take several business days, and may be rejected and require resubmission. We will handle the process on your behalf, but we cannot guarantee approval timelines set by carriers.
8. Intellectual property & ownership
Upon full payment, you own the final deliverables created specifically for your business, along with your phone number, domain, content, and business data. Insom retains ownership of its own underlying tools, templates, systems, and know-how, and may reuse general methods and non-identifying components across clients.
9. Use of results
Unless separately agreed in writing (for example, under a founding-client arrangement), Insom will not publish identifiable client results, names, or logos as case studies without the client's permission.
10. Disclaimers
Our services are provided "as is" and "as available." Except for the specific guarantee in Section 4, we do not warrant any particular level of leads, calls, rankings, revenue, or other business results, as outcomes depend on factors outside our control. Third-party platforms (such as GoHighLevel, Stripe, Google, Meta, and carriers) are governed by their own terms, and we are not responsible for their availability or actions.
11. Limitation of liability
To the fullest extent permitted by law, Insom's total liability arising out of or relating to the services will not exceed the amount you paid to Insom for the specific service giving rise to the claim in the 3 months preceding the event. Insom is not liable for indirect, incidental, special, or consequential damages, or for lost profits or lost data.
12. Governing law
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Georgia.
13. Changes to these Terms
We may update these Terms from time to time. Changes take effect when posted with a new "Last updated" date. Continued use of our services means you accept the updated Terms.
